1. Acceptance of Terms

By creating an account or using AIMotionVideo ("the Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

AIMotionVideo provides an AI-powered platform that transforms static images into motion videos. The Service includes:

  • Image upload and video generation functionality
  • Various motion styles and output formats
  • Account management and video storage
  • API access (for eligible plans)

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have parental or guardian consent to use the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Upload content that you do not have rights to use
  • Create content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Generate deepfakes or manipulated media intended to deceive
  • Create content depicting minors in any inappropriate context
  • Infringe upon intellectual property rights of others
  • Attempt to circumvent usage limits or access restrictions
  • Reverse engineer, decompile, or attempt to extract source code
  • Use automated systems to access the Service in excess of normal usage
  • Resell access to the Service without authorization

We reserve the right to suspend or terminate accounts that violate these guidelines without notice or refund.

5. Content Ownership

Your Content

You retain ownership of the original images you upload. By uploading content, you grant us a limited license to process, store, and transform your images for the purpose of providing the Service.

Generated Content

Videos generated by the Service belong to you, subject to:

  • Your compliance with these Terms
  • Your rights to the source images
  • Applicable laws and third-party rights

Our Technology

AIMotionVideo retains all rights to our AI models, algorithms, software, and other intellectual property. Nothing in these Terms grants you rights to our underlying technology.

6. Payment and Subscriptions

Billing

Paid plans are billed according to the pricing displayed at checkout. Subscriptions automatically renew unless cancelled before the renewal date.

Credit Purchases

Credits purchased are non-refundable and expire according to the terms displayed at purchase. Unused credits do not roll over unless specified.

Refunds

We offer refunds only in cases of technical failure where we are unable to provide the Service as described. Refund requests must be submitted within 14 days of the transaction.

Price Changes

We may change our prices at any time. For existing subscribers, price changes take effect at the next billing cycle with at least 30 days notice.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled or emergency maintenance
  • Technical issues or outages
  • Factors beyond our control

We are not liable for any losses arising from Service unavailability.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIMOTIONVIDEO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or other intangible losses
  • Damages arising from your use or inability to use the Service
  • Unauthorized access to or alteration of your content

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • Generated content will be suitable for any particular purpose
  • Any defects will be corrected

10. Indemnification

You agree to indemnify, defend, and hold harmless AIMotionVideo and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or generate through the Service

11. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access if:

  • You violate these Terms
  • We are required to do so by law
  • We discontinue the Service

Upon termination, your right to use the Service ceases immediately. We may delete your data according to our data retention policies.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of the applicable jurisdiction.

13. Dispute Resolution

Before initiating legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at support@aimotionvideo.com. We will attempt to resolve the dispute within 30 days.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIMotionVideo regarding the Service.
